Joint Statement On Wikileaks
December 21, 2010 – In light of ongoing developments related to the release of diplomatic cables by the organization Wikileaks, and the publication of information contained in those cables by mainstream news organizations, the United Nations (UN) Special Rapporteur on Freedom of Opinion and Expression and the Inter-American Commission on Human Rights (IACHR) Special Rapporteur for Freedom of Expression see fit to recall a number of international legal principles. The rapporteurs call upon States and other relevant actors to keep these principles in mind when responding to the aforementioned developments.
1. The right to access information held by public authorities is a fundamental human right subject to a strict regime of exceptions. The right to access to information protects the right of every person to access public information and to know what governments are doing on their behalf. It is a right that has received particular attention from the international community, given its importance to the consolidation, functioning and preservation of democratic regimes. Without the protection of this right, it is impossible for citizens to know the truth, demand accountability and fully exercise their right to political participation. National authorities should take active steps to ensure the principle of maximum transparency, address the culture of secrecy that still prevails in many countries and increase the amount of information subject to routine disclosure.
2. At the same time, the right of access to information should be subject to a narrowly tailored system of exceptions to protect overriding public and private interests such as national security and the rights and security of other persons. Secrecy laws should define national security precisely and indicate clearly the criteria which should be used in determining whether or not information can be declared secret. Exceptions to access to information on national security or other grounds should apply only where there is a risk of substantial harm to the protected interest and where that harm is greater than the overall public interest in having access to the information. In accordance with international standards, information regarding human rights violations should not be considered secret or classified.
3. Public authorities and their staff bear sole responsibility for protecting the confidentiality of legitimately classified information under their control. Other individuals, including journalists, media workers and civil society representatives, who receive and disseminate classified information because they believe it is in the public interest, should not be subject to liability unless they committed fraud or another crime to obtain the information. In addition, government "whistleblowers" releasing information on violations of the law, on wrongdoing by public bodies, on a serious threat to health, safety or the environment, or on a breach of human rights or humanitarian law should be protected against legal, administrative or employment-related sanctions if they act in good faith. Any attempt to impose subsequent liability on those who disseminate classified information should be grounded in previously established laws enforced by impartial and independent legal systems with full respect for due process guarantees, including the right to appeal.
4. Direct or indirect government interference in or pressure exerted upon any expression or information transmitted through any means of oral, written, artistic, visual or electronic communication must be prohibited by law when it is aimed at influencing content. Such illegitimate interference includes politically motivated legal cases brought against journalists and independent media, and blocking of websites and web domains on political grounds. Calls by public officials for illegitimate retributive action are not acceptable.
5. Filtering systems which are not end-user controlled – whether imposed by a government or commercial service provider – are a form of prior censorship and cannot be justified. Corporations that provide Internet services should make an effort to ensure that they respect the rights of their clients to use the Internet without arbitrary interference.
6. Self-regulatory mechanisms for journalists have played an important role in fostering greater awareness about how to report on and address difficult and controversial subjects. Special journalistic responsibility is called for when reporting information from confidential sources that may affect valuable interests such as fundamental rights or the security of other persons. Ethical codes for journalists should therefore provide for an evaluation of the public interest in obtaining such information. Such codes can also provide useful guidance for new forms of communication and for new media organizations, which should likewise voluntarily adopt ethical best practices to ensure that the information made available is accurate, fairly presented and does not cause substantial harm to legally protected interests such as human rights.

I have come up with a theory about governments and WikiLeaks and how it's all connected and stuff. And it all connects to the Bowling For Soup song, "High School Never Ends." While listening to this song rather late at night, I came up with this.
Governments are like high schools. The only thing that keeps everyone from completely losing it is lies. Lies hold everything up, but lies cause problems too. Usually it's just little things. These are minor leaks. But, there are also the more major problems. The information that when it gets out, can destroy friendships, relationships, trust, etc. These are our major leaks. But the main thing is that most of this will get out at some point. Yet people still do it. It might take days, months, or years to get out, but in the end Sally will find out that Bob is cheating, and the people will find out that governments are just as fucked up as we always thought they were. If the information is passed along to anyone besides yourself, it will get out. Secrets are meant to be broken. The truth is meant to be out.
Or Julian Assange could be Jesus. Which, as ridiculous as it sounds, is almost the tiniest bit plausible when you realize how true everything that is being said is.
We're at day 24 of Cablegate. At 0.7% of the way through, things are already falling apart.

The author of "The Pedophiles Guide to Love and Pleasure: A Child-Lover's Code of Conduct", Phillip Greaves, was arrested in Pueblo, Colarado. Last month, he made news when sparking a debate about free speech and how far it really stretches. His book graphically tells two stories about adults engaging in sexual acts with children, causing it to be removed from Amazon. He was arrested although there has been no allegation that Greaves ever had any illegal sexual contact with a minor.

Bank of America has suspended all payments for WikiLeaks, joining Mastercard, Paypal, and Visa. Shortly after this announcement, WikiLeaks commented via Twitter saying "We ask that all people who love freedom close out their accounts at Bank of America." and "Does your business do business with Bank of America? Our advise (sic) is to place your funds somewhere safer."
Questions are now surfacing about whether alleged WikiLeaks source, Bradley Manning, is being treated humanely. Reports are surfacing that Manning has been kept in solitary confinement for 23 days without a pillow or blankets, and is barred from any access to news or current event programs. His trial is also said to be far from any where near beginning, yet he is already being treated as threat.

Completely unrelated, but the repeal of "Don't Ask, Don't Tell" is one step closer to finally happening. The Senate voted to repeal the law, 65 to 31. The House passed the repeal on Wednesday, 250 to 175. However, the President and Robert Gates, the Defense Secretary, both have to certify that the repeal of "don't ask, don't tell" will not affect military readiness.

So Youtube is (possibly) editing viewing statistics on videos. I wasn't even completely aware of this, but it appears that on some videos, the views stay the same or even go down after long periods of time, even in seemingly rather popular videos. I have no clue if this is actually happening or if it's just speculation and theories. But I wouldn't put it past anyone to change statistics in their favor.

The US Air Force has blocked members from accessing websites of the New York Times, the Guardian, and at least 23 other sites that have published some of WikiLeaks' leaked embassy cables. If members of the air force attempt to access any of the websites, the screen will reportedly read, "Access Denied: Internet usage is logged and monitored." So far, the air force is the only military branch to institute this ban, although it is likely that others may follow, and federal employees have been advised to not read any leaked cables.

Julian Assange Granted Bail

So, this is good. I guess. Now what do the "strict conditions" entail? He has to surrender his passport, agree to stay at one address, report to the police daily, and wear an ELECTRONIC TAG to ensure his compliance with a curfew. And apparently the curfew is a from 10 a.m. to 2 p.m. and 10 p.m. to 2 a.m.

Although OpenLeaks was reportedly going to launch today, if you visit the site you will see nothing but a circle with an arrow (presumably the OpenLeaks logo) and a message that says "Coming soon!"
Also, the Berkeley city council is going to vote on Tuesday on a resulotion that names Bradley Manning a hero, and not a villain. "Blowing the whistle on war crimes is not a crime" the resolution says. Manning currently faces a prison sentence of up to 52 years. If passed, this resolution will show that there are supporters of Manning and WikiLeaks and that people will not just stand back and be censored.

Openleaks
Daniel Domschelt-Berg, who formerly worked with Assange for WikiLeaks is launching a new website, known as Openleaks, that is ment to be a rival to WikiLeaks. It will reportedly not actually host documents, but will act as a third party between those who are producing the information and media organizations. And he's also writing a book called "Inside Wikileaks: My Time at the World's Most Dangerous Website." Oh my.

A 16-year-old boy has been arrested by Dutch police because he is suspected in attacks on Visa and Mastercard. They're really gonna have a hard time arresting every single person that has taken part in these attacks. Everyone's going to end up being labeled as a cyber terrorist. More attacks on websites are suspected to occur in the future, while others are also supporting WikiLeaks at rallies and protests.

Amazon is the latest site to be attacked by hackers. The recent attacks have been based on an attack of a book called "WikiLeaks Documents Expose U.S. Foreign Policy Conspiracies"by Heinz Duthel. People have been accusing the site of hypocrisy for selling this book, but for not hosting any of WikiLeaks documents.

Amazon is the latest site to be attacked by hackers. The recent attacks have been based on an attack of a book called "WikiLeaks Documents Expose U.S. Foreign Policy Conspiracies"by Heinz Duthel. People have been accusing the site of hypocrisy for selling this book, but for not hosting any of WikiLeaks documents.
As of December 9, 9:39 GMT, there have been 1,368 mirrors of the WikiLeaks that have been created.

And... Commence the cyber war.
For some reason, there are people I know that think WikiLeaks is all just a joke. Not that none of it's real or anything, but that it's a joke. That nothing will happen to Julian Assange, and that there will be no overall effect that this could have on the internet, censorship, and technology. They are most likely sadly misinformed.
Also, I'm not sure if this is entertaining or just plain weird.

Julian Assange denied bail
Earlier today, WikiLeaks founder, Julian Assange appeared in court to defend himself against allegations that he "sexually assaulted" two women. He was denied bail based on "weak community ties" in the UK, and his "means and ability" to abscond. He was driven away in a white prison van after the hearing at City of Westminster magistrates court. He will remain in prison until December 14, which is when his case will be reviewed at the same court.
So Julian's in prison. Fuck. Fuck. Fuck. Fuck. Well there goes freedom of speech. There goes any hope of not being censored. Here comes Big Brother.

Not a Big Deal
I honestly believe that the release of the United States diplomatic cables would not have caused such a big problem if it wasn't for one thing: censorship. With the US and many other countries trying to shut down WikiLeaks, it has brought the whole case to public attention. And nobody likes being lied to, especially by their government, which they "rely" on for almost everything. Governments brought this whole issue to attention, and it's caused even more problems.
Now there probably would have been consequences even without all of the media focused on WikiLeaks. But, in no way would it have reached the state that it's at now. It's not just governments that are angry at each other. It's the people, too. People are picking sides in a debate that can decide the future of the entire world. The sides are about tied currently though, making it worrisome to everybody. But, the opposers of WikiLeaks also have many government powers on their side, while supporters have the ordinary citizens with little power if people just act as individuals. It's not just about WikiLeaks though. It's about freedom of speech, freedom of press, freedom of religion. It's almost similar to some sort of debate that could possibly have occurred during the creation of the US Constitution. But on a much larger, and a potentially much more dangerous scale. If any sort of violence does break out, then the world could be doomed.
It's an argument for freedom. And at the moment, it's nothing more than an argument. Whether it remains this way can not be predicted. The future may lay with the future of Mr. Assange. And as much as I hate saying it, I don't know how much longer the future will be able to be with him, as he himself may not be here much longer if death threats keep coming in, and were actually acted upon.
